NOTICE OF PUBLIC HEARING ON A PROPOSED PROJECT ON BEHALF OF MONTANA RENEWABLES, LLC, AND THE ISSUANCE OF REVENUE BONDS TO FINANCE ALL OR A PORTION OF THE COSTS OF CERTAIN SOLID WASTE DISPOSAL AND INDUSTRIAL SEWAGE FACILITIES CASCADE COUNTY, MONTANA
NOTICE IS HEREBY GIVEN that the Board of County Commissioners of Cascade County, Montana (the “County”), will hold a public hearing on November 30, 2022, at 9:30 a.m. in the Commission Office, Courthouse Annex, 325 2nd Avenue North, Room 111, Great Falls, Montana, on a proposal that the County issue its solid waste disposal and sewage facility revenue bonds or notes, in one or more series, in an aggregate principal amount not to exceed $275,000,000 (the “Bonds”), under Montana Code Annotated, Title 90, Chapter 5, Part 1, as amended.
Proceeds of the Bonds would be loaned to Montana Renewables, LLC, a Delaware limited liability company (the “Borrower”), for the purpose of: (i) financing, refinancing or reimbursing all or a portion of the costs of solid waste disposal and sewage facilities pursuant to Internal Revenue Code Section 142(a)(5) and (6), including design, construction, acquisition and installation of improvements capable of producing renewable fuels from feedstock, including tallow; related industrial sewage facilities; and related improvements (collectively, the “Project”); (ii) funding any necessary reserves; (iii) funding interest on the Bonds during construction of the Project, if necessary or desirable; and (iv) paying costs associated with the issuance of the Bonds. The Project will be owned and operated by the Borrower and will be located at 1807 3rd St NW, Great Falls, Montana 59404.
The Bonds will be special, limited obligations of the County, and the Bonds and interest thereon will be payable solely from the revenues pledged to the payment thereof. The Bonds will not give rise to or constitute a pecuniary liability of the County or a charge against its general credit or taxing powers.
